Fashion lawyers (and non-fashion-oriented trademark lawyers, and anyone else who's interested in these things): this writer, of Charles Colman Law, PLLC, has written a fairly in-depth article entitled "A Red-Leather Year for Aesthetic Functionality," which is running in the November/December 2011 of the American Bar Association's official magazine on intellectual property law, LANDSLIDE.

 

The article examines the controversial Louboutin v. YSL case and the broader resurgence of trademark law's "aesthetic functionality" doctrine.  The new issue of LANDSLIDE should arrive in the mailboxes of ABA-IPL members sometime this week; its contents should be posted on the ABA's website in short order.
